Family Law in Hong Kong
Family law in Hong Kong is based on the English common law system. This means that the law is based on case law, or the decisions of judges in previous cases. The main sources of family law in Hong Kong are the Hong Kong Family Proceedings Ordinance and the Hong Kong Matrimonial Causes Ordinance. These ordinances set out the laws relating to marriage, divorce, child custody and other family issues. Family law in Hong Kong covers a wide range of issues, from marriage and divorce to child custody and inheritance. In general, family law in Hong Kong is administered by the courts, although there are a number of government departments that also have a role to play. Family law services encompass a broad range of legal services that are related to families. The most common services offered in this area of law include divorce and separation, child custody and visitation, child support, and spousal support. Family law attorneys also often help clients adopt or terminate parental rights, and they may represent clients in other matters that arise out of family relationships, such as estates and trusts. According to a study by the University of Hong Kong, the divorce rate in Hong Kong has been steadily increasing in recent years and now stands at around 10%. This is significantly higher than the global average of 5%, but still lower than the rates seen in countries such as the United States (50%) and France (40%).
